Today U.S. District Judge Henry Hudson found the individual mandate in Obamacare unconstitutional. This is an important first step in the unraveling of Obamacare. The new Republican House will need to swiftly move to repeal and defund Obamacare. Obama will be able to veto repeal, but he can’t spend money if the Republican House doesn’t authorize it. The court decision will undoubtedly proceed with other lawsuits for a final decision to the Supreme Court. But a Supreme Court ruling could be several years away. While this ruling is important we shouldn’t rely on it for achieving the repeal of Obamacare.
Democrats used to laugh at people questioning the constitutionality of Obamacare. Nancy Pelosi laughed off the question asking “Are you serious?”
The Constitution does not grant the federal government the authority to force Americans to buy a product. Interestingly, the Obama administration now tries to claim that the individual mandate to buy health insurance is really a tax. Further proof that President Obama will lie and say whatever is politically convenient at the time even if it directly contradicts what he previously said. (Remember when Obama said all the Bush tax cuts where for the “rich” and that raising these tax rates would not hurt the economy? Now, with tax deal currently going through Congress, he is saying the opposite, infuriating the Left that elected him.)
